Softekads Studio provides custom web development (Next.js, React, WordPress, Shopify), custom mobile application development (Android/Kotlin), performance marketing management (Google Ads, Meta Ads), search engine optimization (SEO), and data tracking analytics setup.

Every project is executed according to a detailed project proposal, audit report, or written Scope of Work (SOW). Any request outside the agreed scope will be evaluated separately and billed as a change order or separate milestone.

All project engagements are led directly by our founders, Pushpendra Singh (Digital Engineering & Architecture) and Anikesh Singh (Performance Marketing & Growth).

Communication is maintained primarily through scheduled strategy calls, email, and direct WhatsApp communication during standard working hours. We answer project communications within one business day.

Direct Billing: Advertising spend (the money paid to Google Ads, Meta Ads, or other advertising networks) is paid directly by the client to the respective advertising platform using the client's billing method. Softekads Studio's fees cover strategy, account structure, campaign management, and creative optimization only.

Account Access: The client grants Softekads Studio administrative or manager access to their Google Ads, Meta Business Manager, Google Analytics, and Tag Manager accounts to implement and monitor campaigns.

Account Ownership: The client retains 100% ownership of their advertising accounts, customer lists, and pixel data at all times.

Fixed-Scope Projects: Web engineering and development projects generally operate on milestone-based billing (e.g., initial kickoff deposit, mid-project review milestone, and final deployment milestone).

Monthly Growth Retainers: Performance marketing and ad management retainers are billed at the beginning of each monthly billing cycle.

Payment Due Date: Invoices are payable within 7 business days from issuance. Work may be temporarily paused if an invoice is past due.

Upon full settlement of all project invoices, full ownership of custom code, custom designs, domain assets, and marketing creatives developed specifically for the client transfers to the client.

Open-source libraries, third-party software, framework frameworks (such as Next.js or React), and pre-existing studio development boilerplates remain governed by their respective licenses.

While Softekads Studio implements industry-proven engineering best practices, conversion rate optimizations, and data-backed marketing setups, we do not guarantee specific monetary returns, sales figures, or revenue targets. Business performance is also subject to broader market dynamics, client product-market fit, pricing, inventory availability, and third-party algorithm updates (e.g., Google core updates or Meta ad auction fluctuations).

To the maximum extent permitted by applicable law, Softekads Studio shall not be liable for any indirect, incidental, special, or consequential damages, including loss of profits, data loss, or business interruption, arising from website downtime, server host failures, or third-party platform policy enforcements.

Our total aggregate liability under any contract or claim shall not exceed the total fees paid by the client to Softekads Studio for the specific service in dispute during the preceding three months.

These Terms and any project contracts shall be governed by and construed in accordance with the laws of India. Any disputes arising in connection with these terms shall be subject to the exclusive jurisdiction of the competent courts in India.
